What You Need to Know
The Comunidad Valenciana recently issued a new decree regarding rental regulations and licenses. Here are the key changes:
- License Renewal: Rental licenses requested after August 5, 2024, must be renewed every 5 years, including approval from the municipality (compatibilidad urbanística) and any resident associations.
- Exemptions for Older Licenses: Licenses obtained before July 1, 2018, do not require renewal. Licenses issued between July 2, 2018, and August 4, 2024, must be renewed by 2030, with the same requirements as listed above.
- New License on Sale: When a property is sold or ownership changes, a new rental license must be requested.
- No Use of Keyboxes: The use of keyboxes is prohibited. The check-in process must be done in person, with tenant information registered directly. After check-in, someone must always be available for any questions or issues.
- Prohibition on Partial Rentals: Renting parts of a property, such as individual rooms, is prohibited and considered a serious offense with fines up to €600,000.
- Tenant Registration: Failure to properly register tenants with the Guardia Civil is considered a major offense.
- Rentals through Third Parties: When a property is rented out through a third party, the owner remains responsible for any infractions or issues.
- Stricter Controls Using AI: Artificial intelligence will be used to detect illegal rentals, enabling municipalities to conduct more intensive and targeted inspections.

As of October 2023, the profession of real estate agent in Costa Blanca North and South is officially regulated. All agents must now have a registration number, liability insurance, and meet legal guarantees. This applies to foreign agents as well. Your Dutch agent may not sell properties in Spain without being registered in the Valencian registry.
